Fly-tipping mother paid man to remove rubbish

A MOTHER of one who paid someone to dispose of her waste has been handed a conditional discharge for flytipping.

online newsRebecca Coley, of Goodman Street, Burton, admitted failing to dispose of controlled waste on March 7 after her rubbish was found on the corner of Balfour Street and Rowton Street.

Khalid Mahood, prosecuting of behalf of East Staffordshire Borough Council, told Stafford Magistrates’ Court it was the duty of the occupier to take measures to ensure household waste was disposed of correctly.

He said officers from the borough council found the bagged and non-bagged waste and took pictures as evidence.

Due to the large amount of waste, the council’s street services team was contacted to take it back to the depot.

Searches made of the bags found documents belonging to Coley and the council tax database found her new address.

Mr Mahood said the authority accepted she paid a man £50 to get rid of the rubbish, but she did not take reasonable steps to ensure it was being taken away by a responsible person.

He added she could have taken it to the local tip or hired a skip.

Glenn Cook, defending, said the 22- year-old pleaded guilty at the first opportunity and made a full and frank admission when questioned.

He said: “She saw the man collecting rubbish from the street and gave him £50 to get rid of the rubbish from her garden.

Miss Coley accepts she did not take all the steps and measures to ensure that he had the appropriate authority to take away that rubbish.

“This is a harsh lesson as now she has a blemished record. This is not a girl who will find herself before a court ever again.

“She was hoodwinked as this man took the money and then dumped the rubbish.

“I ask the court for a conditional discharge as you will not see her again before this court or any additional court.” Coley a given a conditional discharge for 12 months and ordered to pay £200 costs.
