A 46-year-old man who had been accused of crashing into an elderly pedestrian in Winshill has seen the criminal case against him dismissed by a court.

Brendan Mahoney, of Oxley Road, Burton, had been charged with driving his Land Rover Defender without due care and attention during the alleged incident last year. He had denied the charge.

North Staffordshire Justice Centre, which had been dealing with the case found that no evidence had been offered in relation to the incident and the case was dismissed.

It had been alleged that at 5.45pm on Saturday, December 10, Mr Mahoney was driving in Ashby Road, Winshill , towards its junction with High Bank Road.

He had been intending to turn right into Highbank Road. At this time a pedestrian was in the process of crossing Highbank Road.

It was alleged that the the car failed to see the pedestrian, turned into Highbank Road colliding with them.

The incident was said to have caused serious injury to the pedestrian and damage to the car. The pedestrian suffered from a broken pelvis with a haematoma, broken ribs, laceration to head, fractured spine and coccyx, the court was told.

The road surface was in good condition though damp/wet and the visibility was good, the court had told.

Mr Mahoney's legal costs will be paid from central funds. The exact amount is to be assessed, the court heard.
