A man caught trying to enter a nightclub in Burton with a knife in his pocket has avoided an immediate jail sentence at South Derbyshire Magistrates' Court.

Possession of knife

Edgar Erki, 25, of South Uxbridge Street, Burton, indicated a plea of guilty to having an offensive weapon in a public place, namely a double bladed metal knife, in New Street, Burton, on July 22. He has been made the subject of an eight week prison sentence suspended for 12 months because he tried to enter a nightclub with a knife in his pocket while under the influence of alcohol.

The sentence was suspended as he has no previous convictions and was described as a hard worker. He was ordered to complete 100 hours unpaid work and will pay £85 court costs with a £115 victim surcharge.

Specimen of breath

Almants Libergs, 27, of Burton Road, Branston, admitted failing to provide a specimen of breath in Burton on March 10. He also admitted driving a Renault Laguna on the A38 southbound otherwise than in accordance with a licence and without insurance.

He has been made the subject of a 15-week prison sentence suspended for 12 months because a serious accident was caused. He has been ordered to pay £300 court costs and a £115 victim surcharge and banned from driving for 36 months.

Harassment through messages

A man has admitted harassment. Matthew Pallett, 35, of Dale End Road, Hilton, admitted harassing a woman in Derby on June 23 by texting her with messages and posting on social media messages that were alarming and distressing. He also telephoned her numerous times which was unwanted contact. He has been made the subject of a two-year restraining order. He was fined £576, and ordered to pay £85 court costs with £57 victim surcharge.

Specimen of breath

Czeslaw Kmiecik, 57, of Wyndham Crescent, Burton, admitted failing to provide a specimen of breath in Burton on April 30. He has been made the subject of a 12 month community order and ordered to complete 120 hours unpaid work. He has been ordered to pay £300 court costs and a £85 victim surcharge. He was banned from driving for three years.

Found guilty of assault

A woman has been found guilty of assault. Tammy Clarke, 40, of Shannon Approach, Burton, has been found guilty of assaulting a woman which was racially aggravated in Burton on January 25. She also admitted failing to attend court on August 1 and breaching a conditional discharge.
She has been made the subject of a five-month community order with a five month curfew. She was also ordered to pay £75 compensation, £250 court costs and a £85 victim surcharge.
