A man banned from shops in Swadlincote for five years has breached a court order for a SECOND time after being caught drinking alcohol on the streets in the town centre.

Mark McVey, had already been issued with a fine after breaching his Criminal Behaviour Order the first time by intimidating shopkeepers.

He did this just 15 days after it was imposed by the courts. His case has now gone back to court after he breached the order for a second time. This time he has been made the subject of a suspended jail sentence.

In the latest incident the 46-year-old was caught drinking alcohol in Civic Way, Swadlincote, on May 10, even though he was banned from consuming alcohol in any public area of Swadlincote town centre under the court order.

Derbyshire police have issued a picture of McVey to the media to let the public know what he looks like after the latest incident.

McVey, of Regent Street, Church Gresley, appeared at Southern Derbyshire Magistrates' Court where he admitted breaching his order. He was made the subject of a 12 -week prison sentence which was suspended for 12 months. He was also ordered to pay £85 court costs and a £115 victim surcharge.

McVey's case previously appeared in the Burton Mail in February after he breached his Criminal Behaviour Order just 15 days after it was imposed by the courts.

The order was originally imposed on September 13 as McVey was regularly visiting the offices at South Derbyshire District Council in Swadlincote when drunk and had disrupted staff and customers.

It banned him from entering Swadlincote town centre shops for five years for abusing and pestering visitors and businesses for money or alcohol, and refusing to leave shops when asked.

He also caused problems when visiting Swadlincote Health Centre and admitted causing a nuisance, harassment, alarm or distress to members of staff and members of the public at the health centre in Civic Way on September 17.

Derbyshire Police and the Safer South Derbyshire Partnership had gone to Southern Derbyshire Magistrates' Court to get the order imposed due to McVey's actions.

Shops and businesses even clubbed together to provide evidence about his behaviour which led to the court order being granted on December 28, last year.

When he was sentenced Sergeant Matt Duffield said the Criminal Behaviour Order was there to make sure that the residents of Swadlincote were not exposed to the anti-social behaviour that Mark McVey has committed in the past.

He also said he welcomed the fact police could now deal with this type of behaviour in a short space of time via the courts.

He hoped that over time the order would help McVey change his behaviour. However, if he did not then the order gave the courts the option of dealing with him in a number ways – including a custodial sentence.

Derbyshire police urged anyone who saw McVey in the areas outlined in the order to contact them on the non-emergency 101 number and detail what had occurred.

The police and the Safer South Derbyshire Partnership previously said teams had made numerous attempts to help McVey, but to no avail.

The order he is subject to prohibits him from causing harassment, alarm or distress towards residents, prevents him consuming or carrying alcohol in public areas or entering any retail or business premise within Swadlincote town centre other than a pharmacy or chemist for collecting medication.

It is also states that McVey must leave any public place within Swadlincote town centre when requested to do so by a police officer or a PCSO, or an officer authorised by the council.

Here's what Mark McVey is now banned from doing under the Community Behaviour Order:

1. Causing a nuisance, harassment, alarm or distress to one or more persons not of his household anywhere in South Derbyshire.

2. Using any abusive or intimidating word and gesture towards any individual anywhere in South Derbyshire.

3. Entering any retail or business premises within Swadlincote town centre other than a pharmacy for the purposes of collecting medication or if employed at one of the premises.

4. Remaining in any premises or public building in South Derbyshire if asked to leave by staff.

5. Asking other individuals to purchase alcohol for him from any retail premise within Swadlincote town centre.

6. Carrying or consuming alcohol in any publicly accessable place within the area of Swadlincote town centre.

7. Failing to leave any publicly access place within the area of Swadlincote town centre public space protection order when requested to do so by an authorised officer for the purpose of enforcing the Swadlincote Town Centre public space protection order.
